I do not want my outrage tempered by knowing the facts

One of my particular hates is newspaper columnists (and other “journalists”) misrepresenting the punishments actually doled out by courts, thereby undermining (a) the general deterrence of the actual sentences and (b) efforts by judges to actually rehabilitate offenders so they’re less likely to offend when they’re eventually released – purely so said writers can indulge their readers’ carefully-nurtured (but ignorant) view that courts are “soft”. (As studies have shown, when actually given the facts the general public tends to be no more severe than sentencing judges (usually less severe).

One of the techniques shameless journos use to spread misconceptions about sentencing is only reporting the non-parole period of a jail sentence. For example, the Northern Territory News reported the sentence of a man convicted today of manslaughter as being “at least four years and six months in jail”, only at the very end conceding that the actual sentence was nine years. In the NTN’s favour, they did use the words “at least” and they did, eventually, list the actual sentence. Many news outlets – particularly News Ltd – regularly decline to do either of those things.

Which brings me to how the NTN story has been used by Andrew Bolt in his post today. He introduces the story with the (clearly sarcastic) “A law-abiding man gets the mercy you’d expect, given certain other factors as well”, before quoting parts of the story, emphasising the judge’s finding that the guilty man “did not have an extensive history of violence, and had generally been a law-abiding citizen” and then asking “Er, yes. But explain that word “generally””.

Bizarrely, Andy edits out all reference to the jail sentence the man received, leaving lazy readers who don’t click on the link – and read to the end of it – with the impression that the above mitigating factors resulted in some light sentence. (We already know that his readers are unable to distinguish between a defence and a mitigating factor put in a guilty plea.) And, since what was meant by “generally” – as in “other than on this occasion” – is pretty bloody obvious, we are only left to guess what dog-whistle he’s trying to blow for his readers.

The aboriginal-hating ones have clearly got the message, though, because they’re off and running in the comments… if they are not mistaken, it appears to have been a suggestion that courts are excessively forgiving of aboriginal people being violent. I hope that’s not what Andy was saying, but he hasn’t appeared and corrected his readers, either.

The misleading court reporting is the bit that annoyed me most, though. Imagine what a warped view of the world you’d have if you relied on Andrew Bolt as a source of information!

    the thing about bolt is his unwavering, nazi-like moderation of all things gay and homo, yet his anything goes approach to everything else, including racism. double standards. and crap journalism.

    You are spot on regarding the laziness of some of Bolt’s readers and how they accept his word as gospel even if Bolt (as in this case) uses partial references or picks out part of the full story to make things swing his way.

    The problem is that if his readers do read the full story and get the full facts they will either:
    a) comment and be branded a commo lefty etc etc;
    b) not comment for fear of point a)
    c) not comment because they do not want to fall out of favour with Bolt; or
    d) follow the dog whistle.

    Your world would be almost as warped as if you relied on The NTN for information. Bolt and the NTN teaming up together more often is far too terrible to comprehend.

    Good post, Jeremy, and a point well made. And as you point out, Bolt isn’t the only one who gets up to this kind of caper: outside “mainstream” media it’s bread and butter for certain far-right bloggers, too.

    EvShow – I am with you. how can these people get away with publishing such racist hate on the website of “Australia’s most read newspaper”??

    There are all sorts of calls for apartheid and other things in there. I think the commentators should all be forced to sit and watch the full interview between Andrew Denton and Tania Major and especially watch the highlights of her speech to JWH several years ago when she describes what it was like living in a community.

    15 in her class. 4 dead. she was the only one to finish high school and uni. only girl not to have a child by 15. most alcohol addicted.
    scary stuff.

    And when Denton asked her where the elders were she replied “they are dead”.

    dam buster: to survive in the surreal world of bolt and his sheep you must crash or crash through. i crash through, saying whatever is appropriate, and then challenge any abusers to say something meaningful or shut up. invariably they can’t respond without the dog whistle from bolt, and ‘cannot compute’ when presented with reasoned, rational arguments.

    it’s a blast.

    CoBB – Oh yeah I have had my time there disputing and creating reasoned arguments. It gets tiring and so time consuming when you actually use research and facts to destroy arguments only for Bolt to put up the same story again with a slightly different slant again the next day/week whistling in the dogs to rant the same thing.

  • The law is a hard thing to fathom for us outsiders. I would have no idea what a mitigating factor is. I feel that my fears can be prayed upon by the mainstream news media.

    In Brisbane I get very concerned about why the Courier Mail attacks the legal fraternity with such passion. What are they trying to accomplish? Do they just want influence?
